Applying asylum is not a joke, there are  many things at stake and you if you  think you have that guts to take risk then you go ahead. Experiences say that those who apply after one year of entry to states and with some "valid" reasons (may not be genuine enough in our cases all the time, as we know why) can expect to see some success. If you have the H1B visa and just recently gone to your country to stamp the visa, then that can be your strong point. America wants to keep skilled labor to itself and not some struggling students like you who are still at non-immigrant status.
First make some "believable" story, and there is a great website called "google" that can lead you to help and not some porn to some instant gratification. 
*I seriously have issues with people who were the big time of supporters of Maobadi crap in Nepal, come here and then apply for asylum citing reasons like they got threats from Maos. What the hell!
